The Property Law Subcommittee welcomes Richard Harvey, Principal Solicitor of Richard Harvey & Associates Solicitors.

You will recall Richard being present at our last Annual General Meeting in 2020 as the immediate past president of the New South Wales Law Society.

Richard is a New South Wales Law Society Accredited Specialist in Property Law. Furthermore, he is the Chair of the New South Wales Law Society Property Law Committee and Chair of the New South Wales Law Society Specialist Accreditation Board. Other New South Wales Law Society involvement includes Councillor and Member of the Audit & Finance Committee. He is also Director of Lawcover Insurance Pty Limited amongst other things including involvement in his community.

Richard will present to us on purchasers relying on pre-purchase reports. Our first meeting of 2021 raised questions on liability for vendor commissioned pre-purchase reports. We know that liability issues are raised when a purchaser relies on a vendor commission pre-purchased report. But is there a difference if the report is modified stating it has been prepared for the purchaser?

You each should receive one CPD point for attendance (Substantive Law).

This event will be informal and will provide local law practitioners with an opportunity to meet, socialise and discuss substantive law related issues all online.

Cameron O’Brien Memorial Bursary Dinner Meeting 12 May 2021

The Cameron O’Brien Memorial Bursary was established in memory of Cameron O’Brien, a Commerce/Law Student from the Sutherland Shire in his 4th year of study at The University of Wollongong (UOW) when he died tragically in 2012 of Sudden Unexpected Death in Epilepsy (SUDEP). Cameron was the son of His Honour Judge Chris O’Brien who is a past president and life member of our Regional Law Society. The Bursary was established in 2013 and has been awarded annually since then.

This year we will be awarding two separate bursaries to two successful applicants, being the Cameron O’Brien Memorial Bursary in the sum of $3,000 and the Highly Commended Bursary in the sum of $1,000.

The criteria for applicants are that they must be students who are:

  • Enrolled at the University of Wollongong in their 4th year of study in a combined LLB degree program or the LLB program.
  • Residents of the St George/Sutherland area or former residents who attended primary or high school in the St George/Sutherland area AND

The successful applicants are determined on academic merit and personal circumstances.

We will be announcing the successful applicants during the course of our dinner meeting.

Family Law Sub-Committee Meeting with Senior Registrar Brett McGrath of the Family Court of Australia 22 April 2021

Senior Registrar Brett McGrath of the Family Court of Australia has kindly offered to present to us, with a topic to be announced shortly.

If time permits we will also have the opportunity to engage in a ‘Q&A’ with the Senior Registrar in relation to any questions and/or comments that you may have.

Senior Registrar McGrath commenced his career in private practice in 2012 at Marsdens Law Group in south-western Sydney, before joining the national firm Gadens in 2018, practicing exclusively in family law.

Elected to the Council of the Law Society of New South Wales in 2018, Senior Registrar McGrath has sat on various committees including the Family Issues Committee, Professional Conduct Committee, and the Committee for Diversity and Inclusion.

Senior Registrar McGrath became a Registrar with the Family Court of Australia and Federal Circuit Court of Australia in 2019. He was then selected as one of two National Registrars to oversee and implement the new National COVID-19 List designed to triage and hear urgent family law matters arising from the COVID-19 pandemic, as well as being involved in the development of the expansion of the Courts’ ADR functions. Most recently, he has been appointed as a Senior Registrar of the Family Court and Federal Circuit Court of Australia.

Unfortunately, Mary Walker is no longer able to present to us on “Negotiation and Mediation Advocacy”. In her place, we have been able to secure Hai-Van Nguyen, a Senior Associate from Clayton Utz who will be presenting to us on her work with clients who have experienced domestic and family violence in the context of Victims Support. 

The presentation will focus on client interviewing and advocacy which will satisfy the Rule 6.1.3 mandatory topic of Professional Skills.

THE SUCCESSION LAW SUBCOMMITTEE MEETING “THE BLENDED FAMILY IN WILLS CONTEXT”

The Succession Law subcommittee is hosting its first meeting for the year next Tuesday 9 March 2021. 

 The meeting will be held in person at the salubrious offices of Elliott Tuthill. 

 Raoul Wilson SC of 8 Wentworth Chambers will be presenting on the topic of “The blended family in wills context”.

Raoul Wilson SC of 8 Wentworth Chambers (and formerly of Gymea!), whose specialty is advising and appearing in unique, complex and high profile wills cases, has kindly offered to present to us on the topic of “The blended family in a wills context”. The talk will cover the areas of the widow’s primacy in family provision claims (following Steinmetz v Shannon), mutual wills, testamentary contracts, proprietary estoppel claims and unconscionability claims (following Mentink v Olsen).

CANCELLED Family Law subcommittee Meeting 18 February 2021

The Family Law SubCommittee Meeting this Thursday is now cancelled

For those that are not aware, the Senate debated the matter yesterday (scheduled without notice the night prior!) and it appears that key members of Senate are in support of the proposed Merger Bill. Whilst the vote has not yet taken place (and is expected to take place anytime between now and the end of the week), given the numbers in support of the Merger Bill it is expected to pass. Accordingly, we have discussed the matter and consider it best to postpone this particular meeting until the Bill is enacted. At that time, we can then meet to discuss our new Act, how it impacts us as practitioners, and how it will impact our work with clients.

Family Law subcommittee Meeting 18 February 2021

The Family Law subcommittee are holding a meeting this Thursday 18 February 2021 to discuss the bill for the proposed merger of the Family Court and Federal Circuit Court, and whether it would be appropriate for our Regional Law Society to prepare correspondence to our local member and the Prime Minister, Scott Morrison expressing the views of our members in relation to the Merger Bill. The meeting will commence at 5.30pm and will be held in person at the office of Southern Waters Legal.

The Law Society of NSW’s Solicitor Outreach Service (SOS) connects NSW solicitors to confidential, psychological support.

You can call the Solicitor Outreach Service on 1800 592 296 for access to:

  • Up to three psychological sessions per financial year, paid for by the Law Society of NSW; and
  • 24/7 telephone counselling with a psychologist if you are in crisis or distress

If your or someone else’s life is in danger, phone 000 immediately.

SOS is an initiative of the Law Society of NSW delivered by third party provider, PeopleSense by Altius.

Family Law – Lighthouse Project

Today Chief Justice Alstergren will officially launch the Lighthouse Project which is a unique project designed and developed by the Family Court of Australia and Federal Circuit Court of Australia that aims to identify issues of family violence and to support vulnerable families involved in family law disputes.

Cameron O’Brien Memorial Bursary

The Cameron O’Brien Memorial Bursary was established in memory of Cameron O’Brien, a Commerce/Law Student from the Sutherland Shire in his 4th year of study at The University of Wollongong (UOW) when he died tragically in 2012 of Sudden Unexpected Death in Epilepsy (SUDEP). Cameron was the son of His Honour Judge Chris O’Brien who is a past president and life member of our Regional Law Society. The Bursary was established in 2013 and has been awarded annually since then. Including this year, we have awarded 10 Bursaries worth over $13,000.

This year, in addition to the usual Cameron O’Brien Memorial Bursary, which this year increased to the sum of $3,000, we also awarded a second Highly Commended Bursary in the sum of $1,000.

The criteria for applicants are that they must be students who are:

  • Enrolled at the University of Wollongong in their 4th year of study in a combined LLB degree program or the LLB program.
  • Residents of the St George/Sutherland area or former residents who attended primary or high school in the St George/Sutherland area AND

The successful applicant is determined on academic merit and personal circumstances. As well as the monetary component of the Bursary there is up to 10 days work experience offered at law firms in the St George Sutherland area, together with invitations to Regional Law Society dinner meetings and Young Lawyer and other functions.

The Bursary fosters a mutual beneficial relationship between UOW and the St George Sutherland Law Society. The Bursary not only provides financial assistance to a UOW student who is in need, but also provides an invaluable opportunity for students to meet with legal practitioners and to bridge the gap between studying law, and law in practice. It also offers members of our Regional Law Society the opportunity to meet law students aspiring to find a future in the law, to offer them work experience and other work and social opportunities.

As is the case each year, the selection committee was impressed with the high quality of the Applications received and the task of selecting the successful applicants was difficult.

We are pleased to announce that the successful recipients of the Bursary this year are as follows:

  1. Cameron O’Brien Memorial Bursary – Jacob Moussa 
  2. Highly Commended Bursary – Jenna Lennon

Congratulations to both Jacob and Jenna!

We further extend our thanks to John Littrich of UOW for his assistance in promoting the Bursary and facilitating the application process.

AGM

Good Morning All,

We are very much looking forward to seeing you all tonight at our AGM at Hazlehurst. We have a great night planned for you with good food, good wine and good company!

The AGM will be held from 6.00pm to 6.30pm. It will be held outside on the balcony (weather permitted) overlooking the beautiful grounds of Hazlehurst with cheese and drinks to be served to those who are in attendance. There will be an opportunity to mingle in small groups at tables on the balcony from the conclusion of the AGM until the commencement of the dinner meeting at 7.00pm.

During the dinner meeting, we will be presenting the Cameron O’Brien Bursary to our lucky recipients. Our guest speakers for the evening are the President of the Law Society of NSW, Richard Harvey along with the newly appointed CEO, Sonja Stewart.
